This new legislation has recently been tested for the first time in supreme court with regard to 9 environmental permits for anti-hail cannons in the municipality of Borsele. In its judgment dated 13 September 2017, the Council of State declared the appeal in its entirety unfounded and allowed the 9 licenses to be upheld.
